What is design licensing?
Design licensing means purchasing the right to commercially use the artwork - this means you can use the design to create products to sell.
Custom designs
I would love to work with you on an exclusive custom design. The process for this would involve us working together to bring your idea to life. We will discuss what you are after, colours, scale etc and I can use this information to start work on a design. I will involve you in the process, sharing work as go, so I know you are happy with the direction of the design. Changes can be made along the way but excessive changes may incur an extra fee.
The cost and time frame for this service varies dependant on complexity and my availability.
What is the difference between exclusive and non-exclusive licensing?
- Exclusive means the design will be for use by you only, it will not be sold on to anyone else.
- Non-exclusive means the design has no limit to the amount of people who can buy and use it.
If i buy a pattern tile can i print fabric and make things to sell?
Yes.
Can i change the design (colours, scale etc)?
No, when you purchase a design it is for that particular design only but I am more than happy to discuss design changes before you purchase.
Did you draw/create all the work?
Yes, all the designs on my page were hand drawn by me.
May i get a different file type?
I set my files up as jpeg but if you require something else please let me know before purchasing and i can sort that out for you.
LICENSE AGREEMENT
NON-EXCLUSIVE LICENSE AGREEMENT
Pattern files are allowed to be used in an unlimited number of Projects (any digital, print or surface to which the Licensed Design is applied). You are permitted to use the design on items for sale. This license is non-exclusive and can be used by multiple licensees.
1. GRANT OF LICENCE
In consideration of payment to Arch & Aya (Kristy Holding) of the Licence Fee, Kristy Holding hereby grants to you a non-exclusive licence of the purchased design.
2. USAGE
Non-exclusive designs may be used on products for sale (excluding on-selling the pattern file). This license is granted for 18 months, from the time of purchase. After this time the pattern will need to be repurchased or use ceased. There are no restrictions to the number of units allowed to be made within this time frame.
3. LIMITATION OF USE
You may not:
- Sell, share, license or in any other way provide the design file for use by anyone else.
- Alter the design in any way, this includes (but is not limited to) colour, scale, additions to or removable of any part of the design.
- Claim to be the creator of the artwork or design.
- Use the design in any way that is considered pornographic, defamatory, infringing or in any way libellous in nature.
4. OWNERSHIP AND INTELLECTUAL PROPERTY
You acknowledge that you do not obtain any Intellectual Property Rights whatsoever of the Licensed Design by virtue of this Agreement.
The ownership/intellectual property of the design remains with Arch & Aya (Kristy Holding).
5. PRICING AND PAYMENT
I. You acknowledge that the Licence Fee is that displayed on www.archandaya.com or via invoice when you enter into this agreement.
II. Once payment has been made to Kristy Holding, in accordance with the methods of payment set out on the Website www.archandaya.com or via invoice, a dropbox link to the design file will be emailed to your nominated email address.
6. REFUND POLICY
Refunds are not permitted on the sale of design files.
It is the buyer’s responsibility to check the suitability of files prior to purchases.
7. TERMINATION OF AGREEMENT
The license of the design may be revoked if the terms of this agreement are not adhered to.
